LIABILITY WAIVER & RELEASE

INDEMNIFICATION, WAIVER, AND RELEASE OF LIABILITY

By signing this Indemnification, Waiver, and Release of Liability (“Waiver”), you acknowledge and agree that you are voluntarily participating in fitness classes, wellness activities, workshops, events, and other services offered or hosted by Seventh House LLC, a Pennsylvania limited liability company (“Seventh House”), and that participation involves inherent risks of injury, illness, property damage or loss, and other risks.

You hereby hold harmless, waive, release, and discharge Seventh House LLC and its respective members, managers, officers, instructors, employees, agents, contractors, representatives, and other personnel (collectively, “Seventh House”) from and against any and all liability, losses, costs, expenses, causes of action, claims, judgments, liens, litigation, penalties, orders, violations, and damages, including reasonable attorneys’ fees, costs, and expenses, arising out of or related to personal property damage or loss, personal bodily injury, illness, or wrongful death, whether caused by negligence or otherwise, except to the extent caused by the gross negligence or willful misconduct of Seventh House, to the extent such release is permitted by applicable law.

This Indemnification, Waiver, and Release applies to any and all services, activities, classes, sessions, workshops, and events offered or hosted by Seventh House (collectively, the “Services”), including, but not limited to:

  • Mat Pilates

  • Sculpt classes

  • Yoga

  • Sound baths

  • Strength training

  • HIIT (high-intensity interval training)

  • Other mat-based fitness, movement, wellness, and related activities

The Services may involve physical exertion, exercise, stretching, movement, changes in body position, balance activities, strength training, cardiovascular activity, and the use of fitness-related equipment and props.

This Waiver applies while you are present at or using the premises located at:

800 North Easton Road, Store 2, Doylestown, Pennsylvania 18902

or at any other location where Services are provided by Seventh House (collectively, the “Premises”).

ASSUMPTION OF RISK

You acknowledge that participation in the Services involves inherent mental and physical risks, including, but not limited to, muscle soreness or strain, sprains, strains, falls, loss of balance, dizziness, fatigue, cardiovascular events, illness, injury, aggravation of pre-existing conditions, and other physical or medical harm.

You voluntarily assume all such risks, known and unknown, associated with participation in the Services.

You acknowledge that the Services are not a substitute for medical diagnosis, treatment, or advice and that Seventh House and its instructors are not acting as your physician or healthcare provider.

You acknowledge that your participation in all Seventh House Services is voluntary, undertaken at your own risk, and based on your own assessment of your physical and mental fitness to participate.

You agree to follow all reasonable instructions provided by instructors and to notify an instructor of any medical conditions, injuries, limitations, or other circumstances that may affect your ability to safely participate.

PERSONAL PROPERTY

You acknowledge and agree that Seventh House is not responsible for the safekeeping of personal property brought onto or left at the Premises.

You voluntarily assume the risk of loss, theft, or damage to personal property, including but not limited to clothing, bags, wallets, keys, electronic devices, jewelry, and other personal belongings.

RELEASE OF CLAIMS

You agree that neither you, nor your heirs, executors, administrators, agents, or legal representatives, will initiate or pursue any claim or legal action against Seventh House for any personal injury, illness, property damage or loss, or wrongful death arising out of or related to the Services or use of the Premises, whether caused by negligence or otherwise, except to the extent caused by the gross negligence or willful misconduct of Seventh House, to the extent such release is permitted by applicable law.

This release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Pennsylvania.

MEDICAL ACKNOWLEDGMENT AND ELIGIBILITY REQUIREMENTS

You represent and warrant that you are physically and mentally capable of participating in the Services and that you are not aware of any medical condition, injury, illness, or impairment that would prevent you from safely participating.

You acknowledge that Seventh House has not provided you with medical advice and that it is your responsibility to consult with a physician or other qualified healthcare professional prior to participating in the Services if you have any health concerns, medical conditions, injuries, illnesses, physical limitations, or other concerns regarding your ability to participate safely.

You agree to immediately discontinue participation in any activity and notify an instructor if you experience pain, dizziness, shortness of breath, discomfort, unusual fatigue, or any other symptoms that may indicate a medical issue.

You voluntarily assume full responsibility for monitoring your own physical condition during participation in the Services and for determining whether to continue or discontinue participation.

EMERGENCY MEDICAL CARE

In the event of an injury, illness, or medical emergency occurring during or in connection with your participation in the Services, you authorize Seventh House and its instructors, employees, agents, or representatives, to seek or arrange reasonable emergency medical assistance on your behalf when they determine that such assistance may be necessary or appropriate.

You understand and agree that Seventh House is not responsible for the cost of any medical treatment, emergency services, transportation, hospitalization, or other medical care provided to you.

AGE REQUIREMENT

Participants must be at least eighteen (18) years of age to participate in any Services offered by Seventh House.

No individual under the age of 18 is permitted to attend or participate in any class, session, workshop, event, or other Service offered by Seventh House. Seventh House does not accept parental or guardian consent as a substitute for this age requirement.

By signing this Waiver, you represent and warrant that you are at least eighteen (18) years of age.

ACKNOWLEDGMENT AND AGREEMENT

By signing this Waiver, you acknowledge and agree that:

  1. You have read this Waiver carefully and understand its terms.

  2. You understand that participation in the Services involves inherent risks of injury, illness, property damage or loss, and other risks.

  3. You voluntarily assume those risks.

  4. You understand that you are giving up substantial legal rights by agreeing to this Waiver.

  5. You have had the opportunity to ask questions regarding this Waiver before signing it.

  6. You are voluntarily agreeing to this Waiver without coercion or undue influence.

  7. You intend for this Waiver to be legally binding upon you and your heirs, executors, administrators, agents, and legal representatives, to the fullest extent permitted by applicable law.

This Waiver shall remain effective for your participation in Services offered by Seventh House unless revoked or replaced in writing, to the extent permitted by applicable law.
